“أفعال وليس عقوبات”.. أحمد مصطفى: هل العقوبات سليمة ولفظها وارد في ميثاق الأمم المتحدة؟!

نسمع كثيرا هذه الأيام عما يسمى بالعقوبات الاقتصادية وأنها يتم تنفيذها بموجب الفصل السابع لميثاق الأمم
المتحدة – هل هذه العقوبات سليمة أو كلمة عقوبات واردة في الميثاق؟
أود ان أشير ان الفضل في كتابة هذا المقال هو السفير السوري وممثل سوريا الدائم السابق لدى الأمم المتحدة السيد/ بشار الجعفري – عندما أقر في آخر برنامج له على راديو سبوتنك الروسي – أن مصطلح “عقوبات”
لم يرد في الفصل السابع لميثاق الامم المتحدة.
حيث أن عنوان هذا الفصل يستخدم مصطلح أفعال وليس عقوبات – كما ان اهم مادتين في هذا الفصل وهو
المادتين ٤١ و٤٢ المعنيتين بالتدخل الدولي يذكرا إجراءات أو تدابير والشرط الاهم هو موافقة مجلس الأمن
وخصوصا الدول دائمة العضوية.
وعليه فهل ما يتخذ من عقوبات ضد روسيا يتفق وميثاق الأمم المتحدة وبموافقة مجلس الأمن؟
الاجابة هي ال( وكافة العقوبات التي تم اتخاذها سابقا وتم تنفيذها وصولا للأعمال العسكرية والتي يتم
الموافقة عليها وفي حالة الإبادة البشرية والفصل العنصري والخطر الذي يهدد الشعوب لم تنطبق على كافة
الحالات التي تم تطبيق العقوبات والضربات العسكرية عليها.
ومن أهم هذه الأمثلة طبعا ٧٤ سنة من الفصل العنصري من الكيان ضد شعبنا الفلسطيني – ضرب العراق
في ٢٠٠٣ من قبل الناتو ومقتل ما يقرب من ٥.١ مليون مواطن عراقي من الأبرياء وفقا لإدعاءات كاذبة
(أسلحة الدمار الشامل والتي اكتشفنا أنها مسحوق غسيل ملابس) ونحن في الذكرى الـ ١٩ للغزو الامريكي
للعراق.
ضرب ليبيا في نهاية ٢٠١١ والتخلص من نظام شرعي يتمتع بالشرعية والسيادة، وهو نظام الرئيس السابق
معمر القذافي، وكذلك محاولة العبث وتخريب سوريا بسبب رفض النظام السوري مرور أنبوب الغاز الخليجي إلى أراضيه للعلاقات الاستراتيجية بين سوريا وروسيا.
الأمر الذي ترتب عليه انشاء الحزب الديموقراطي في أمريكا لـ داعش بموجب التسريبات الخاصة من إيميل هيلاري كلينتون الشخصي.
وإذا كانت كل من أمريكا والغرب تدعي حرية التعبيروالديمقراطية لماذا تمنع القنوات الروسية من العمل لديها ومخاطبتها للجماهير الغربية.
وايضا لماذا لا تستضيف شخصيات روسية على قنواتها كنوع من احترام الموضوعية في الطرح والتي يدعون بها كذبا كما تفعل القنوات الروسية أو القنوات التي تتعاطف مع روسيا.
يظل السؤال الخاص لماذا لم تدخل روسيا في وقت غزو العراق ووافقت على ضربات الناتو له في عام
٢٠٠٣ ضمن مجلس الأمن؟
لم تكن روسيا بوتين، والذي حكم بلد مفكك مترامي الاطراف منذ عام ٢٠٠٠ ،وفي مدة أقصاها ٣ سنوات، أن يعترض على قرار الناتو ولم يكن في مصلحته.
ولأن بوتين في هذا الوقت كان خائفا من ان تتعرض روسيا لمشاكل دولية، وكان هو في غنى عنها في بداية عهده، حتى يتمكن من إنقاذ سلطته على هذا البلد الكبير الذي طعنه الغرب في مقتل بعد تفكك الاتحاد
السوفياتي.
هل يمكن استبعاد روسيا من مجلس الامن والامم المتحدة؟
الاجابة لا( لانه مع الخبرة السيئة في الغرب مع فرض عقوبات أحادية الجانب على روسيا – ظنا منه خطأ انه يمكن ان يقلم مخالب روسيا – فقد انقلب السحر على الساحر وارتفعت أسعار الطاقة ارتفاعا جنونيا (النفط والغاز) .
والمتابعين للشأن الغربي يمكن أن يشاهدوا فيديوهات المواطنين في اوروبا الغربية وتهافتهم على شراء السلع
من المتاجر الكبرى خوفا من الارتفاع الجنوني في أسعارها، لارتفاع أسعار الطاقة الروسية وتدخل سلسلة التوريد الصينية، وكأن العقوبات اضرت من فرضها أكثر.
ينطبق نفس الحال على المنظمة الدولية للامم “الامم المتحدة” فلو حدث مثل هذا التصرف الاعوج وخصوصا
ان وجود روسيا والصين يشكل توازنا دوليا مع النيوليبرالية ألامريكية – فسيجعل المنظمة تفقد سمعتها بشكل
كبير وقد يؤدي هذا على المدى المتوسط إلى انحلالها اصلا.
وخصوصا لأن الصين على الجانب الاخر تقدم مبادرتها )طريق الحرير( كحل افضل وبديل للامم المتحدة
كون ان احد عقائد الصين الاساسية عدم التدخل في الامور الداخلية للغير واحترام سيادة الغير، على عكس ما
تقوم به أمريكا وحلفائها في العالم.
فستصبح أمريكا وبريطانيا وفرنسا في حرج كبير في حال استبعاد روسيا من المنظمة الكبيرة، وربما سيكون
لروسيا أن تبني تحالفات مضادة مع الصين من دول حليفة، تلك الدول التي صوتت لصالحها وكذلك التي امتنعت في الجمعية العامة للامم المتحدة.
هناك سؤال أخير ملح يطرح نفسه – أين فزاعة وباء كورونا من الوضع الحالي – أليس من المستغرب أننا لم نسمع عن فيروس كورونا وترك المتظاهرون في دول أوروبا الغربية يتجمعون دون أدنى إجراءات سالمة.
فهل الازمة الاوكرانية كـ أزمة خارجية، كانت سبب في ازاحة وطوق النجاة لأنظمة الغرب الكاذبة بحسب وصف مواطنيها اثناء حدة الوباء من سنتين لتخفيف الضغوط الداخلية على حكوماتها؟
هذا بالفعل ما يحدث حاليا وهذا هو أم التضليل العالمي بعينه إبقاء الأنظمة النيوليبرالية الموالية لأمريكا على حد معرفتي.

Charter?
We hear a lot these days about the so-called economic sanctions and that they are
implemented under Chapter VII of the Charter of the United Nations – are these
sanctions sound or the word sanctions contained in the Charter?
I would like to point out that the credit for writing this article belongs to the Syrian
ambassador and the former permanent representative of Syria to the United
Nations, Mr. Bashar al-Jaafari – when he admitted in his last program on Russian
radio Sputnik – that the term “sanctions” did not appear in Chapter VII of the
Charter of the United Nations.
Since the title of this chapter uses the term “actions” and not “punishments” – the
two most important articles in this chapter, Articles 41 and 42 concerned with
international intervention, mention procedures or measures, and the most important
condition is the approval of the Security Council, especially the permanent
members.
Accordingly, are the sanctions taken against Russia, in accordance with the Charter
of the United Nations and with the approval of the Security Council, right?
The answer is (no), and all the sanctions that were previously taken and
implemented to reach military actions, which are approved, and in cases of
genocide, apartheid and danger to peoples did not apply to all cases where military
sanctions and strikes were applied.
Among the most important of these examples, of course, is 74 years of apartheid
from the Zionist entity against our Palestinian people – the attack on Iraq in 2003
by NATO and the killing of nearly 1.5 million innocent Iraqi citizens according to
false claims (weapons of mass destruction, which we discovered to be laundry
powder) and we On the 19th anniversary of the US invasion of Iraq.
It struck Libya at the end of 2011 and got rid of a legitimate regime enjoying
legitimacy and sovereignty, the regime of the former martyr Muammar Gaddafi, as
well as attempts to tamper and sabotage Syria because of the Syrian regime’s
refusal to pass the Gulf gas pipeline to its territory due to the strategic relations
between Syria and Russia.
This resulted in the creation of ISIS by the Democratic Party in America, according
to private leaks from Hillary Clinton’s personal email.
And if both America and the West claim freedom of expression and democracy,
why do they prevent Russian channels from working into their borders and
addressing them to Western audiences?
Also, why do they not host Russian figures on their channels? As a kind of respect
for objectivity in the proposition, which they falsely claim, as do Russian channels,
or channels that sympathize with Russia.
The special question remains, why did not Russia enter at the time of the invasion
of Iraq and approved the NATO strikes on it in 2003 within the Security Council?
Putin’s Russia, which has ruled a sprawling disintegrated country since 2000, and
for a maximum period of 3 years, would not have objected to NATO’s decision and
was not in its interest.
Because Putin at this time was afraid that Russia would be exposed to international
problems, and he was indispensable at the beginning of his reign, in order to be
able to enforce his authority over this great country that was stabbed by the West in
death after the dissolution of the Soviet Union.
Can Russia be excluded from the Security Council and the United Nations?
The answer is (no), because with the bad experience in the West with imposing
unilateral sanctions on Russia – mistakenly thinking that it could trim Russia’s
claws – magic has turned on the magician and energy prices (oil and gas) have
skyrocketed.
Those who follow Western affairs can watch videos of citizens in Western Europe
rushing to buy goods from supermarkets for fear of the crazy rise in their prices,
due to the rise in Russian energy prices and the interference of Chinese supply
chains, as if the sanctions had harmed who imposed it more.
The same applies to the mother international organization “the United Nations.” If
such a perverted behavior occurred, especially since the presence of Russia and
China constitutes an international balance with American neoliberalism – it will
make the organization lose its reputation significantly, and this may lead in the
medium term to its dissolution in the first place.
Especially because China, on the other hand, presents its initiative (Silk Road) as a
better and alternative solution to the United Nations, since one of China’s basic
beliefs is non-interference in the internal affairs of others and respect for the
sovereignty of others, unlike what America and its allies do in the world.
America, Britain and France will be in great embarrassment if Russia is excluded
from the great organization, and perhaps Russia will have to build
counter-alliances with China from allied countries, those countries that voted in
favor of it and those that abstained in the United Nations General Assembly.
There is one last urgent question – where is the scarecrow of the “Corona
Pandemic” in the current situation – is it not surprising that we have not heard
about the Corona virus and left protesters in Western European countries to gather
without the slightest safety measures.
Was the Ukrainian crisis, as an external crisis, the reason for the displacement and
lifeline of the false Western regimes, as described by its citizens, during the
severity of the pandemic two years ago, to ease the internal pressures on their
governments?
This is indeed what is happening now, and this is the mother of the same media
disinformation to keep the neoliberal regimes loyal to America, to the best of my
knowledge.
